KES TRACTOR RENTAL AGREEMENT

By reserving and renting a tractor from Killebrew’s Engineering Services, the renter agrees to the following terms and conditions.

## 1. Rental Rates

* **2 Hours:** $125
* **4 Hours:** $195
* **Full Day:** $295
* **Weekend:** $695
* **Full Week:** $1,395

Available attachments are limited to the **rotary cutter and tiller**.

## 2. Holding Fee

A **$50 non-refundable holding fee** is required to reserve the selected rental date and time.

The holding fee is separate from the rental price and is **not applied toward the rental balance**.

The remaining rental balance is due **upon pickup before the tractor is released**.

## 3. Rescheduling & Cancellation

Customers who need to reschedule must provide **24–48 hours' notice**.

Rescheduling is subject to availability. A new rental date is not guaranteed until confirmed by KES.

Cancellations do not qualify for a refund of the $50 holding fee.

## 4. Pickup & Return

The renter is responsible for picking up and returning the tractor at the agreed-upon location and time.

The renter must return the tractor and any rented attachments in substantially the same condition in which they were provided, excluding normal wear and tear.

## 5. Late Returns

A **15-minute grace period** is allowed for returns.

A **$50 late-return fee** may be charged when the tractor is returned more than 15 minutes after the agreed return time.

Extended delays may result in additional rental charges based on the applicable rental rate.

## 6. Renter Responsibilities

The renter agrees to:

* Operate the tractor responsibly and only for its intended purpose.
* Follow all applicable safety instructions and operating procedures.
* Use appropriate personal protective equipment.
* Not allow unauthorized individuals to operate the tractor.
* Not operate the tractor while impaired by alcohol, drugs, or any substance that could affect safe operation.
* Immediately notify KES of any accident, damage, malfunction, or unsafe condition.
* Secure the tractor when it is unattended.

## 7. Damage & Repairs

The renter is responsible for damage caused by misuse, abuse, negligence, improper operation, unauthorized use, or failure to follow operating instructions.

The renter may be responsible for reasonable repair costs, replacement costs, or other expenses resulting from such damage.

Normal wear and tear is not considered renter-caused damage.

## 8. Attachments

KES currently provides the following attachments for rental:

* Rotary Cutter
* Tiller

Attachments must be used only for their intended purposes and operated according to applicable safety and operating requirements.

The renter is responsible for damage caused by improper use or operation.

## 9. Inspection

KES may inspect the tractor and attachments before and after each rental.

The renter is encouraged to report any existing damage or mechanical concerns before taking possession of the equipment.

## 10. Transportation & Towing

Unless otherwise agreed in writing, the renter is responsible for transportation of the tractor and any rented equipment.

The renter is responsible for ensuring that any vehicle, trailer, tie-down equipment, or transportation method used is appropriate and legally capable of transporting the equipment.

## 11. Prohibited Use

The tractor may not be used for illegal activities or in a manner that creates an unreasonable risk of injury, property damage, or equipment damage.

KES reserves the right to terminate a rental if the equipment is being used in an unsafe, abusive, or unauthorized manner.
